Terms & Conditions

By placing an order with Bake You Happy, you agree to be bound by the following terms and conditions. Please read them carefully before ordering. These terms constitute a legally binding agreement between you ("the Customer") and Bake You Happy ("we", "us", "our"), operated by Paulina Cichocka.

1. Placing an Order

All cake orders are bespoke and made to your individual requirements. An order is confirmed only when:

  1. The design, size, flavour and event date have been agreed in writing (via WhatsApp, email or our website)
  2. A non-refundable booking deposit has been received and confirmed

Important: No cake production will commence until a booking deposit has been received in full. We cannot reserve dates, source ingredients, or begin any preparation without a confirmed deposit.

2. Deposits & Booking Fees

A minimum booking deposit of £50 is required to secure your order and event date. For orders over £200, a deposit of 50% of the total order value is required.

Important: All deposits are strictly non-refundable, regardless of whether the order proceeds or not. By paying the deposit, you acknowledge and accept this condition.

The deposit covers:

  • Reservation of your event date in our calendar
  • Design consultation and planning time
  • Sourcing of specialist ingredients and materials

If you fail to pay the deposit within 48 hours of your agreed booking, we reserve the right to release your date and offer it to another customer.

3. Payment Terms

The remaining balance of your order must be paid in full no later than 7 days before your event date. Payment can be made via bank transfer or Stripe.

Important: Cakes will only be released for collection or delivery once full payment has been received and confirmed. No exceptions.

If full payment is not received by the due date:

  • We reserve the right to cancel your order
  • Your deposit will be forfeited and non-refundable
  • We are under no obligation to hold your cake or event date

4. Cancellations & Refunds

Cancellation by the Customer

  • More than 14 days before event date: Your deposit is forfeited. No further charges apply.
  • 7–14 days before event date: 50% of the total order value is due (including your deposit).
  • Less than 7 days before event date: The full order value is due. No refund will be issued.

Important: Once an order is confirmed and a deposit has been paid, cancellations are non-refundable. Ingredients may have already been purchased, and your date has been reserved exclusively for you.

Cancellation by Bake You Happy

In the unlikely event that we need to cancel your order (due to illness, emergency or force majeure), we will:

  • Notify you as soon as possible
  • Offer an alternative date or a full refund including your deposit
  • Make every effort to recommend a trusted alternative baker if we cannot fulfil your order

5. Changes to Orders

Minor changes to your order (flavour swaps, small colour adjustments) may be accommodated up to 10 days before your event, subject to availability and at our discretion.

Significant changes (size upgrades, complete redesigns, additional tiers) may incur additional charges and will need to be agreed in writing. We cannot guarantee that major changes can be accommodated at short notice.

Changes requested fewer than 7 days before the event cannot be guaranteed and may not be possible.

6. Collection & Delivery

Collection

Cakes are available for collection from our Chingford, E4 premises. You will be given a collection time window. Please be punctual — cakes left uncollected beyond the agreed time may not be stored safely and we accept no responsibility for uncollected orders.

Delivery

We offer personal delivery across London and surrounding areas. Delivery charges vary based on distance and will be quoted at the time of ordering.

Upon delivery or collection, you are responsible for the safe handling of the cake. We take every care to ensure cakes arrive in perfect condition, but once the cake has been handed over, we cannot be held liable for any damage that occurs.

7. Allergens & Dietary Requirements

All cakes are prepared in a home kitchen where nuts, gluten, eggs, dairy and soya are present. While we take every precaution, we cannot guarantee a completely allergen-free environment.

It is the Customer's responsibility to inform us of all allergies and dietary requirements at the time of ordering. We will do our best to accommodate, but cannot accept liability for allergic reactions.

Specific ingredients can be provided upon request for each cake order.

8. Photography & Social Media

We reserve the right to photograph all cakes we create and use these images on our website, social media, portfolio and marketing materials. No personal details will be shared alongside images.

If you do not wish your cake to be photographed or shared, please inform us in writing before your event date.

Reference images provided by the Customer are used as inspiration only. While we strive to match designs as closely as possible, each cake is handcrafted and minor variations are to be expected. We do not guarantee exact replicas of reference images.

9. Complaints & Disputes

We take pride in every cake and your satisfaction is important to us. If you have a complaint, please contact us within 24 hours of receiving your cake, including photographs where relevant.

We will investigate promptly and offer a fair resolution. However, we cannot offer refunds or replacements based on matters of personal taste, or for issues arising after the cake has left our care.

All disputes will be governed by the laws of England and Wales.

10. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: severe weather, pandemic, supply chain disruption, power failure, or transport strikes.

11. Limitation of Liability

Our total liability to you in connection with any order shall not exceed the total amount you have paid for that order. We are not liable for any indirect, consequential, or incidental losses arising from your order.

12. General

  • These terms and conditions apply to all orders placed with Bake You Happy.
  • We reserve the right to update these terms at any time. The version in effect at the time of your order will apply.
  • If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force.
  • These terms are governed by the laws of England and Wales.
